Booking terms & conditions

1.1  You can book accommodation at RAC Parks and Resorts either online, on the phone, or in person at RAC Parks and Resorts.

1.2  When you make a Booking more than 7 days before your Arrival Date, you may be required to pay a deposit (Deposit) up to the total cost of your Booking. You will then be required to pay the balance of your Booking at least 3 days prior to your Arrival Date. If the balance has not been paid by this time, our team will charge the credit card on file for the outstanding amount.

1.3  When you make a Booking where the Arrival Date falls within the next 7 days, you may be required to pay the total cost of your Booking.

1.4  RAC will advise you of your Rate Information when making a Booking, we will also advise you of your Rate Information in communications regarding your Booking and your Agreement.

1.5  Once you pay for your Booking (either in whole or in part), you will be deemed to have accepted these Terms.

1.6 Once we have processed the payment for your Booking, we will confirm the details of your Booking with you in writing. This confirmation creates an agreement between You and Us (Agreement).

1.7  You must pay for your Booking in Australian dollars.

1.8  If you pay by Amex, MasterCard or Visa credit or debit card we will charge a card surcharge of 0.67% of the total transaction value. The surcharge amount will be displayed at the point of booking before you proceed to payment. We reserve the right to vary the surcharge in accordance with the applicable costs and merchant fees in accepting a credit card payment at any time without prior notice.

1.8.1 EFTPOS payments will not be charged a surcharge.

1.8.2 If you choose to pay for your Booking via BPAY, you acknowledge and agree that all BPAY transactions are final and non refundable. Once a BPAY payment has been processed, it cannot be cancelled, reversed, or refunded.

1.9 Some of our properties offer Rates that include breakfast, if you make a Booking on a Rate with breakfast included, or purchase breakfast online as an Add-on, the following terms apply;

1.9.1 If making a Booking which has breakfast included, this may be served as buffet style or al a carte at the discretion of the property, and based on demand in the Breakfast Outlet.

1.9.2 If an included breakfast is not consumed, it is forfeited and will not be refunded or credited to your Booking.

1.9.3 If breakfast is unavailable for any reason, your Booking will be adjusted to our room only rate and we will advise you at our earliest convenience.

1.10 There may be instances where you try to make a Booking but we are unable to accommodate you. We try to avoid this as much as possible, but if this happens, we will notify you that your Booking has been unsuccessful.

2.1 If you would like to change your Booking for any reason, you must obtain RAC’s prior consent to do so.

2.1.1 Changing your Booking within the Cancellation Restricted Period is not permitted. Changes within this period will be treated as a cancellation and penalties noted in clauses 3.2 and 3.5 will apply.

2.2 While we will try our best, RAC may not be able accommodate your request to change your Booking for any reason whatsoever.

2.3 If we agree to change your Booking, we may adjust the Rate that applies to your Booking to reflect the applicable Rate on the changed Booking dates. In legal terms, this varies the Agreement between you and us. In practical terms, this means that the total cost of your Booking may change.

3.1 We understand that from time to time, you may need to cancel your Booking.

3.2 If you have booked a Special Offer Rate, Promotion Rate, Advanced Saver Rate or Discounted Rate, and you wish to cancel your Booking, all clauses in section 9 apply, this means you may be subject to cancellation fees and clause 3.5 may not apply.

3.3 If you have booked a School Holiday Repeat Booking and you wish to cancel your Booking, all clauses in section 5 apply, this means you may be subject to cancellation fees and clause 3.5 may not apply.

3.4 If you have booked an Anytime Repeat Booking and you wish to cancel your Booking, all clauses in section 6 apply.

3.5 If you cancel your Booking, then the following cancellation policy applies:

3.5.1 If you cancel your Booking more than 72 hours before the Standard Time on your Arrival Date, you will receive a full refund.

3.5.2 If you cancel your Booking less than 72 hours before the Standard Arrival Time on your Arrival Date, you forfeit your Deposit.

3.5.3 The forfeited Deposit cannot be transferred to another date, or placed in credit for future use without written consent from RAC.

3.5.4 Once you have checked in, if you make changes to your Booking, such as leave early, you will forfeit the full amount set out in your Booking. This is, you will not receive a refund for nights unused

3.6 If you are a No Show your Booking will be cancelled and you will not be entitled to a refund. That is, you will still be required to pay the full amount set out in your Booking.

4.1 For your safety, it’s important we know who is staying at RAC Parks and Resorts at any given time. For this reason, your Booking:

4.1.1 is provided to you in your personal capacity (and any other guests named on the Booking in theirs); and

4.1.2 cannot be transferred, resold, or otherwise changed into the name of another person.

5.1 We may offer the opportunity during selected WA school holiday periods for our guests to repeat their Booking for the same school holiday period the following year (School Holiday Repeat Booking). If you would like to make a School Holiday Repeat Booking, then all clauses in this section 5 apply.

5.2 When making a School Holiday Repeat Booking, you must:

5.2.1 attend the relevant RAC Parks & Resorts reception desk;

5.2.2 select your Booking dates and your Repeat Dates using our calendar available from the relevant RAC Parks and Resorts reception to identify the Comparable Annual Date; and

5.2.3 select the same accommodation category as your Booking.

5.2.4 To secure your School Holiday Repeat Booking, you must either book before (whichever comes first):

5.2.4.1 the last day of your Booking; or

5.2.4.2 5pm the day before the start of a Member Pre-Sale as advertised on our website or otherwise communicated to you by RAC.

5.3 Any amendment to a School Holiday Repeat Booking that would cause the arrival date and/or departure date to fall outside the applicable Western Australian school holiday period is not permitted and may be declined at the sole discretion of RAC Parks and Resorts.

5.4 If you cancel your School Holiday Repeat Booking at any time, you will forfeit your Deposit. For clarity, the cancellation policy in section 3 does not apply to School Holiday Repeat Bookings.

5.5 If you would like to extend your School Holiday Repeat Booking to include days outside the Repeat Dates, you can do so if the accommodation is available after the time period specified in clause 5.2.4.2.

5.6 School Holiday Repeat Bookings may not be available for all categories and all properties. You can find details of excluded accommodation categories and properties here.

6.1 We may offer the opportunity our guests to repeat their Booking for the same period the following year outside of WA School Holidays (Anytime Repeat Booking). If you would like to make an Anytime Repeat Booking, then all clauses in this section 6 apply.

6.2 When making an Anytime Repeat Booking, you must:

6.2.1 Follow the process detailed on our Anytime Repeat Booking web page; and

6.2.2 select your Booking dates and your Repeat Dates using our calendar available at the relevant RAC Parks and Resorts reception to identify the Comparable Annual Date; and

6.2.3 select the same accommodation category as your Booking.

6.2.4 To secure your Anytime Repeat Booking, you must book on your arrival date

6.3 Any amendment to an Anytime repeat booking that would cause the arrival date and/or departure date to fall outside the Comparable Date Period is not permitted and may be declined at the sole discretion of RAC Parks and Resorts.

6.4 If you cancel your Anytime Repeat Booking the clauses in section 3 apply.

6.5 If you would like to extend your Anytime Repeat Booking to include days outside the Repeat Dates, you can do so if the accommodation is available within 364 days of your Departure Date.

6.6 Anytime Repeat Bookings may not be available for all categories and all properties. You can find details of exclusions on our Anytime Repeat Bookings webpage.

7.1 RAC Members are eligible to a preferential RAC Member Rate as a member benefit. These RAC Member Rates are exclusive to RAC Members and are as advertised on our website.

7.2 An RAC Member must be a fully paid member of The Royal Automobile Club of WA (Inc).

7.3 To receive these preferential RAC Member Rates, you must:

7.3.1 provide your valid RAC Member number when prompted, if booking online; or

7.3.2 advise staff verbally, if booking over the phone.

7.3.3 be an RAC Member during the full period of the booking

7.3.4 be an Occupant of the accommodation set out in the booking

7.4 RAC Members are required to show current proof of membership on the Arrival Date.

7.5 RAC Member Rates are only available if your Booking is made in the same name as the RAC Member card shown on the Arrival Date.

7.5.1 An RAC member booking may include up to two Bookings, meaning one Additional Booking is permitted for guests of the RAC Member for the same period.

7.5.2 The RAC Member name will be attached to the Additional Booking.

7.5.3 The RAC Member is responsible for the conduct of the guests of the Additional Booking.

7.5.4 The RAC Member is responsible for the payment of the Additional Booking and the terms and conditions applied to the Additional Booking.

7.6 RAC Member Rates are only valid for direct bookings made with RAC Parks and Resorts. Third party bookings will not be eligible to receive the RAC Member Rates.

8.1 From time to time, RAC may offer members a fixed time window to book key WA holiday periods before the rest of the general public (RAC Member Pre-Sale). The dates of RAC Member Pre-Sales will be advertised online.

8.2 These Terms will apply for bookings made through the RAC Member Pre-Sale and for bookings open to the general public.

9.1 RAC may offer sales, promotions, specials, event rates, or other discounts on its Rates from time to time.

9.2 If you make a Booking in line with a Special Offer Rate, Promotion Rate or Discounted Rate, your Booking will be subject to:

9.2.1 block out periods, including but not limited to school holidays, public holidays, and other special events;

9.2.2 potential limits on the types of accommodation available to be booked at your chosen location;

9.2.3 Deposit amounts that may be equal to the total cost of your Booking;

9.2.4 certain limitations upon the length of your booking e.g. some rate types may prescribe a minimum or maximum number of nights in the Booking; and

9.2.5 cancellation fees may apply.

9.3 The special terms and conditions that apply to Special Offer Rates, Promotion Rates or Discounted Rates may change from time to time and will always be published online

9.4 If you wish to make a booking on an Advance Saver Rate, your booking will be subject to:

9.4.1 potential limits on the types of accommodation available to be booked at your chosen location;

9.4.2 If you cancel your Booking more than 7 days before the Standard Time on your Arrival Date, you will receive a full refund.

9.4.3 If you cancel your Booking less than 7 days before the Standard Arrival Time on your Arrival Date, you forfeit your Deposit.

9.4.4 The forfeited Deposit cannot be transferred to another date, or placed in credit for future use.

9.4.5 Once you have checked in, if you make changes to your Booking, such as leave early, you will forfeit the full amount set out in your Booking. This is, you will not receive a refund for nights unused.

10.1 You are solely responsible for your property at all times at any of the RAC Parks and Resorts.

10.2 If your property is lost, stolen, or damaged at any of the RAC Parks and Resorts, we are under no obligation to:

10.2.1 replace the property;

10.2.2 compensate you for; or

10.2.3 be liable for any loss or damage suffered as a result.

10.3 To the maximum extent permitted by law, we are not responsible or liable for any accident, damage, loss or harm whatsoever whether arising directly or indirectly, including but not limited to loss suffered to property or person, damage, fatality, physical or psychological injury, inconvenience, loss of enjoyment, disappointment or health related issue howsoever arising from, relating to or connected with your stay at RAC Parks and Resorts (including transit to and from RAC Parks and Resorts) or the Booking.

10.4 You agree that any transaction at RAC Parks and Resorts between you and any person or business not affiliated with RAC is conducted at your own risk.

10.5 You agree to fully and finally release and discharge us from any liability, claim, action, right or entitlement whatsoever you have against us whether known or unknown, whether accrued, contingent or inchoate arising out of, concerning or relating to your stay at RAC Parks and Resorts (including transit to and from RAC Parks and Resorts) or the Booking.

10.6 If you wish to claim any refund you must contact the relevant RAC Parks and Resorts directly by calling 1800 871 570.

10.7 If a condition or warranty cannot be excluded at law then you agree to the fullest extent permitted by law that our liability for a breach of the condition or warranty shall be, at our sole election, the re-supply or payment of the cost of re-supply of the relevant goods or services. All other conditions and/or warranties are expressly excluded to the fullest extent permitted by law.

10.8 You fully indemnify us against any loss, liability, damage, action, demand, expense, claim, fine, charge or obligation which we have or may suffer or incur by reason of or in any way consequent upon, arising out of or incidental to the non-performance or non-observance of the obligations and liabilities imposed on you under this Agreement or by reason of or concerning or arising out of any conduct, act or omission by you on or related to your stay at RAC Parks and Resorts (including transit to and from RAC Parks and Resorts) or the Booking.

11.1 We take your privacy seriously and treat your personal information strictly in accordance with our obligations under the Privacy Act 1988 (Cth).  The RAC Group Privacy Policy is available here or by phoning 13 17 03.

11.2 These Terms and the Agreement are governed by the laws of Western Australia and you agree to submit to the exclusive jurisdiction of the courts of Western Australia.

11.3 If any clause in this Agreement becomes invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining clauses of this Agreement shall not in any way be affected or impaired.

11.4 This Agreement may only be varied by a document in writing executed by all parties’ authorised representatives.

11.5 You acknowledge and accept the above Terms applying with respect to the Booking and acknowledge having read and understood them. You understand that no other agreement or disclaimer, verbal or otherwise, applies as this Agreement together with the itinerary contains the entire agreement between you and us.

11.6 You confirm you are over 18 years of age and free to enter into these Terms and the Agreement.

11.7 We do not accept school leaver bookings. We do not have the policies, procedures or resources to accommodate groups from school leavers during the annual “Leavers” period. In particular, we do not have adequate resources to engage qualified security personnel to guarantee the safety, comfort and convenience of guests during this period. For this reason, we reserve the right to reject bookings from school leavers for the entire “Leavers” period for all RAC Park and Resorts.

11.8 We may cancel this Agreement at any time if we believe your Booking may cause disruption to the operation of RAC Parks and Resorts, other RAC members or guests.

12.1 Despite anything contained in these Terms and Conditions, the Australian Consumer Law (“ACL”) gives you statutory rights including guarantees and remedies that cannot be excluded or modified by these Terms and Conditions. The ACL guarantees and remedies include (depending on the type of failure, fault, or defect) repair or replacement, a refund, compensation for reasonably foreseeable loss or damage, or a resupply of the goods or services if the goods or services do not meet the standards required by the ACL. These Terms do not purport to exclude any statutory rights available to you and must in all cases be read subject to those statutory rights.

13.1 Any notice required to be given by a party under the Agreement must be given in accordance with the particulars set out in the Purchase Pages or these Terms.

13.2 It is your responsibility to keep your contact details, including your email address and postal address up to date and notify RAC of any changes to those details as soon as possible.

14.1 The Agreement may be terminated by RAC at any time by notice in writing to you if you breach these Terms.

14.2 You are bound by the latest version of these Terms. RAC will use reasonable endeavours to notify you of any changes to the Terms and Conditions by placing a notice on the Website. Where there are material changes to these Terms that could adversely affect or limit your rights under the Agreement, RAC will provide additional notice to you by way of the address or email address you have provided to RAC and you thereafter have the right to cancel your Booking in accordance with clause 14. Where possible, we will endeavour to give at least 1 months’ notice of such changes.

15.1 RAC is committed to protecting the privacy of your personal information. To the extent RAC deals with your personal information RAC will comply with the Act and collect, use, hold and disclose personal information in accordance with the Australian Privacy Principles contained in the Act.

15.2 By proceeding with your Booking, you confirm that you have read and acknowledge the terms of our privacy policy.  Our privacy policy includes information about safeguards in place for your personal information.

15.3 For more detailed information about how RAC collects, stores and uses your personal information in the course of its business activities, please view the RAC Privacy Policy.  Alternatively, please call RAC on 13 17 03 if you would like RAC to send you a hard copy of the policy.

16.1 The Agreement is governed by the laws in force in the State of Western Australia, Australia.

17,1 If you have a query or dispute in relation to the Agreement we ask that you contact RAC by telephone on 1800 871 570.  For international guests, or those calling outside Australia, please refer to your booking confirmation email for property contact details.

“Add-on” means an additional product or service added to your Booking at the time of making your Booking or at any time before your Arrival Date.

“Additional Booking” means a booking made by an RAC member for friends or family with the same arrival date and booking length as the booking.

“Advance Saver Rate” means a rate for your Booking that may be at a discounted Rate, sold more than 7 days in advance of your Arrival Date and will have clauses noted in section 9.

“Anytime Repeat Booking” has the meaning given to it in clause 6.1 of these Terms.

“Arrival Date” means the date you’re set to arrive as set out in your Booking.

“Agreement” has the meaning given to it in clause 1.6 of these Terms.

“Auto Club” means any of the following: Royal Automobile Club of Queensland Limited, Royal Automobile Club of Victoria (RACV) Limited, National Roads and Motorists’ Association, Royal Automobile Club of Tasmania Limited, Royal Automobile Association of South Australia Incorporated, and Automobile Association of the Northern Territory Incorporated.

“Breakfast Outlet” means the location in which breakfast may be served.

“Booking” means your reservation for accommodation at RAC Parks and Resorts.

“Comparable Annual Date” means the corresponding date to your Booking dates if making a Repeat Booking, which is determined using RAC’s online calendar here. For example, if your Booking is for the first weekend of February then your Repeat Booking must also be for the first weekend of February the following year (even if the calendar dates are slightly different).

“Cancellation Restricted Period” means the timeframe prior to arrival when a Deposit is forfeited if you were to cancel your Booking.

“Deposit” has the meaning given to it in clause 1.2 of these terms.

“Discounted Rate” means a rate for your Booking that may be at a discounted Rate and will have clauses noted in section 9.

“GST” means goods and services tax imposed or to be imposed under the A New Tax System (Goods and Services Tax) Act 1999 (as amended) (Cth) and any related imposition Acts of the Commonwealth, or any Act in substitute for them.

“Holiday” means the booking of accommodation at one of the RAC Parks and Resorts.

“No Show” means the event where You do not present at the RAC Parks and Resorts on your Arrival Date.

“Occupant” means a person staying in the accommodation or on the site that the booking has been made for.

“Personal Information” has the meaning given to it in the Privacy Act 1988 (Cth).

“Promotional Rate” means a rate for your Booking that may offer promotional benefits and will have clauses noted in section 9

“RAC” means RAC Tourism Assets Pty Ltd (ACN 168 253 085) of 832 Wellington Street, West Perth, Western Australia 6005.

“RAC Member” means a fully paid member of The Royal Automobile Club of WA (Inc).

“RAC Member Rate” means a rate for your Booking that is strictly available to RAC Members.

“RAC Member Pre-Sale” has the meaning given to it in clause 8.1 of these Terms.

“RAC Parks and Resorts” means any one of the following RAC resorts and holiday parks: RAC Karri Valley Resort, RAC Busselton Holiday Park, RAC Monkey Mia Dolphin Resort, RAC Exmouth Cape Holiday Park, Ningaloo Reef Resort, RAC Cervantes Holiday Park, RAC Margaret River Nature Park, RAC Cable Beach Holiday Park, and RAC Esperance Holiday Park, or any other holiday park owned, operated or leased by us.

“Rate(s)” means the price per night outlined in your Booking and is based on two people unless expressly provided otherwise.

“Rate Information” means the information relating to the type of booking, along with information relating to Special Offer, Promotion, Discounted, Advanced Saver or Flexible bookings.  

“School Holiday Repeat Booking” has the meaning given to it in clause 5.1 of these Terms.

“Repeat Dates” means the date of a Repeat Booking which reflects the Comparable Annual Date.

“Special Offer Rate” has the meaning given to it in Section 9 of these Terms.

“Standard Arrival Time” means 2pm on your Arrival Date.

“Terms” means these terms and conditions that you are currently reading.

“us, our, we” means RAC Tourism Assets Pty Ltd (ACN 168 253 085) of 832 Wellington St, West Perth WA 6005.

“you or your” means you, our valued member or customer, as set out in the Booking (and includes any other person who participates in, is present at or attends the Booking as a participant).
